<b><u>COVERAGE</u></b>: Questions shall strictly fall within the defined Syllabus for every subject. The Syllabi shall be released through a Bar Bulletin or before December 31, 2012. The cut-off for Supreme Court decisions covered by the 2013 Bar Examinations shall be January 31, 2013.</div>

<b><u>EXAM STRUCTURE & FORMAT OF QUESTIONS</u> </b></div>
<ol style="text-align: justify;">
<li>The Examination shall consist of 20% Multiple Choice Questions (MCQ) and 80% Essay-type questions.</li>
<li>Whether MCQ or essay, the questions shall be based on a given set of facts, presented as briefly but as clearly and completely as possible, taking into account that every examinee needs reading, understanding, consideration of the applicable law, and answering time for every question. The whole examination should be answerable by the average bar examinee within 3 .5 hours (210 minutes) to allow him or her 30 minutes of review time.</li>
<li>The basic elements of problem solving that the Examiners shall particularly look for are: the examinee's (1) proper understanding and appreciation of the facts, particularly of the components or details that can be material in resolving the given problem; (2) his or her appreciation of the applicable laws that may come into play; (3) recognition of the issues posed; and the ( 4) resolution of the issues through the analysis and application of the law to the given facts. The examinee's presentation and articulation of his or her answer shall also be given weight.</li>
<li>The 20% MCQ portion of the examination shall be divided into 4 or 5 main fact situations from which the MCQ questions shall be asked. The 80% essay portion of the exam shall be divided into eight (8) divisions of ten (10) points each, with a maximum of two facts per division from which question shall be drawn. The corresponding weight of each question shall properly be indicated in the questionnaire, together with estimated answering time, to allow the examinee proper allotment of his or her exam time.</li>

FATS:<br />
Nora Moulic issued to Corazon Victoriano, as security for pieces of jewelry to be sold on commission, 2 post-dated Equitable Banking Corporation. Thereafter, the payee negotiated the checks to the State Investment House Inc. (SIHI). Moulic failed to sell the pieces of jewelry, so she returned them to the payee before maturity of the checks. The checks, however, could no longer be retrieved as they had already been negotiated. Consequently, before their maturity dates, Moulic withdrew her funds from the drawee bank. Upon presentment for payment, the checks were dishonored for insufficiency of funds. SIHI allegedly notified Moulic of the dishonor of the checks and requested that it be paid in cash instead, although Moulic avers that no such notice was given her. SIHI sued to recover the value of the checks. Moulic contends that she incurred no obligation on the checks because the jewelry was never sold and the checks were negotiated without her knowledge and consent. She also instituted a Third-Party Complaint against Corazon Victoriano, who later assumed full responsibility for the checks. The trial court dismissed the Complaint as well as the Third-Party Complaint. SIHI elevated the order of dismissal to the Court of Appeals, but the appellate court affirmed the trial court on the ground that the Notice of Dishonor to Moulic was made beyond the period prescribed by the Negotiable Instruments Law and that even if SIHI did serve such notice on Moulic within the reglementary period it would be of no consequence as the checks should never have been presented for payment. SIHI filed the petition for review.<br />
<br />
ISSUE:<br />
WON the alleged issuance of the post-dated checks as mere security is a ground for the discharge of the instrument?<br />
<br />
HELD<br />
Section 119 of the Negotiable Instrument Law outlined the grounds in which an instrument is discharged. The grounds are:<br />
(a) payment by or on behalf of the principal debtor;<br />
(b) payment by accommodated;<br />
(c) intentional cancellation of instrument by the holder;<br />
(d) any act which discharges a contract;<br />
(e) reacquisition of principal debtor in his own right.<br />
<br />
Section 119 of the NIL is exclusive to its enumerations. Obviously, MOULIC may only invoke paragraphs (c) and (d) as possible grounds for the discharge of the instrument. But, the intentional cancellation contemplated under paragraph (c) is that cancellation effected by destroying the instrument either by tearing it up, burning it, or writing the word "cancelled" on the instrument. The act of destroying the instrument must also be made by the holder of the instrument intentionally. Since MOULIC failed to get back possession of the post-dated checks, the intentional cancellation of the said checks is altogether impossible. On the other hand, the acts which will discharge a simple contract for the payment of money under paragraph (d) are determined by other existing legislations since Section 119 does not specify what these acts are, e.g., Art. 1231 of the Civil Code which enumerates the modes of extinguishing obligations, such as:<br />
a. Payment or performance;<br />
b. Loss of the thing due;<br />
c. Condonation or remission of debts;<br />
d. Confusion or merger of rights of creditor and debtor;<br />
e. Compensation;<br />
f. Novation<br />
<br />
Again, none of the modes outlined therein is applicable in the instant case as Section 119 contemplates of a situation where the holder of the instrument is the creditor while its drawer is the debtor. Herein, the payee, Corazon Victoriano, was no longer MOULIC's creditor at the time the jewelry was returned. Correspondingly, MOULIC may not unilaterally discharge herself from her liability by the mere expediency of withdrawing her funds from the drawee bank. PHILIPPINE NATIONAL BANK VS. COURT OF APPEALS<br />

FACTS:<br />
Ministry of Education Culture issued a check payable to Abante Marketing and drawn against Philippine National Bank (PNB). Abante Marketing, deposited the questioned check in its savings account with Capitol City Development Bank (CAPITOL). In turn, Capitol deposited the same in its account with the Philippine Bank of Communications (PBCom) which, in turn, sent the check to PNB for clearing. PNB cleared the check as good and thereafter, PBCom credited Capitol's account for the amount stated in the check. However, PNB returned the check to PBCom and debited PBCom's account for the amount covered by the check, the reason being that there was a "material alteration" of the check number. PBCom, as collecting agent of Capitol, then proceeded to debit the latter's account for the same amount, and subsequently, sent the check back to petitioner. PNB, however, returned the check to PBCom. On the other hand, Capitol could not in turn, debit Abante Marketing's account since the latter had already withdrawn the amount of the check. Capitol sought clarification from PBCom and demanded the re-crediting of the amount. PBCom followed suit by requesting an explanation and re-crediting from PNB. Since the demands of Capitol were not heeded, it filed a civil suit against PBCom which in turn, filed a third-party complaint against PNB for reimbursement/indemnity with respect to the claims of Capitol. PNB, on its part, filed a fourth-party complaint against Abante Marketing.<br />
The Trial Court rendered its decision, ordering PBCom to re-credit or reimburse; PNB to reimburse and indemnify PBCom for whatever amount PBCom pays to Capitol; Abante Marketing to reimburse and indemnify PNB for whatever amount PNB pays to PBCom. The court dismissed the counterclaims of PBCom and PNB. The appellate court modified the appealed judgment by ordering PNB to honor the check. After the check shall have been honored by PNB, the court ordered PBCom to re-credit Capitol's account with it the amount. PNB filed the petition for review on certiorari averring that under Section 125 of the NIL, any change that alters the effect of the instrument is a material alteration.<br />
ISSUE:<br />
WON an alteration of the serial number of a check is a material alteration under the NIL.<br />
HELD:<br />
NO, alteration of a serial number of a check is not a material alteration contemplated under Sec. 125 of the NIL.<br />
RATIO:<br />
An alteration is said to be material if it alters the effect of the instrument. It means an unauthorized change in an instrument that purports to modify in any respect the obligation of a party or an unauthorized addition of words or numbers or other change to an incomplete instrument relating to the obligation of a party. In other words, a material alteration is one which changes the items which are required to be stated under Section 1 of the Negotiable Instruments Law.<br />
In the present case what was altered is the serial number of the check in question, an item which is not an essential requisite for negotiability under Section 1 of the Negotiable Instruments Law. The aforementioned alteration did not change the relations between the parties. The name of the drawer and the drawee were not altered. The intended payee was the same. The sum of money due to the payee remained the same. The check's serial number is not the sole indication of its origin. The name of the government agency which issued the subject check was prominently printed therein. <br />
FACTS:<br />
• Complainant Remedios Tapucar and respondent Atty. Lauro Tapucar were married with 11 children. When respondent became a CFI judge, he cohabited with Elena Peña of whom he had 2 children. A certain Atty. Tranquilino Calo filed an administrative complaint against respondent for immorality. After investigation, the penalty of suspension from office for a period of six months without pay was meted by this Court upon respondent.<br />
• Despite this penalty, respondent still continued to cohabit with Elena, giving rise to another charge of immorality and other administrative cases, such as: conduct unbecoming an officer of the court, and grossly immoral conduct. These cases were consolidated and after investigation, this Court ordered his dismissal and separation from the service. But his dismissal as a judge did not impel respondent to mend his ways, and even continued living with Elena. Moreover, he completely abandoned complainant and his children.<br />
• Respondent later contracted marriage with Elena while the respondent's marriage to complainant subsists. Upon knowing of that her children allegedly misery because of their father's acts, including deception and intrigues against them. Complainant filed the present petition for disbarment under the compulsion of the maternal impulse to shield and protect her children from the despotic and cruel acts of their own father.<br />
<br />
ISSUE:<br />
Whether or not the respondent’s actuations merit the penalty of disbarment?<br />
<br />
HELD:<br />
Respondent Atty. Lauro L. Tapucar is hereby DISBARRED. The Clerk of Court is directed to strike out his name from the Roll of Attorneys.<br />

RATIO:<br />
<br />
The Code of Professional Responsibility mandates that:<br />
Rule 1.01. A lawyer shall not engage in unlawful, dishonest, immoral or deceitful conduct.<br />
Rule 7.03. A lawyer shall not engage in conduct that adversely reflects on his fitness to practice law, nor should he, whether in public or private life, behave in a scandalous manner to the discredit of the legal profession.<br />
<br />
Members of the Bar, must live up to the standards and norms expected of the legal profession, by upholding the ideals and tenets embodied in the Code of Professional Responsibility always. Lawyers must maintain a high standard of legal proficiency, as well as morality including honesty, integrity and fair dealing. For they are at all times subject to the scrutinizing eye of public opinion and community approbation. Needless to state, those whose conduct — both public and private — fails this scrutiny would have to be disciplined and, after appropriate proceedings, penalized accordingly.<br />
<br />
In the case at bar, keeping a mistress, entering into another marriage while a prior one still subsists, as well as abandoning and/or mistreating complainant and their children, show his disregard of family obligations, morality and decency, the law and the lawyer's oath. Such gross misbehavior over a long period of time clearly shows a serious flaw in respondent's character, his moral indifference to scandal in the community, and his outright defiance of established norms. All these could not but put the legal profession in disrepute and place the integrity of the administration of justice in peril, hence the need for strict but appropriate disciplinary action.<br />
<br />
Moreover, it should be recalled that respondent here was once a member of the judiciary, a fact that aggravates his professional infractions. For having occupied that place of honor in the Bench, he knew a judge's actuations ought to be free from any appearance of impropriety. For a judge is the visible representation of the law and, more importantly, of justice. Ordinary citizens consider him as a source of strength that fortifies their will to obey the law. Indeed, a judge should avoid the slightest infraction of the law in all of his actuations, lest it be a demoralizing example to others. Surely, respondent could not have forgotten the Code of Judicial Conduct entirely as to lose its moral imperatives. <br />
<br />
Such gross misbehavior over a long period of time clearly shows a serious flaw in respondent's character, his moral indifference to scandal in the community, and his outright defiance of established norms. All these could not but put the legal profession in disrepute and place the integrity of the administration of justice in peril, hence the need for strict but appropriate disciplinary action.<br />

OBLENA<br />AC No. 376 April 30, 1963<br />En Banc, Barrera<br /><br />FACTS:<br />• Complainant Josefina Royong charge the respondent Ariston Oblena, a member of the bar and bench, with rape. The Solicitor General immediately conducted an investigation and found out that there was no rape, the carnal knowledge between complainant and respondent seems to be consensual sex.<br />• In view of his own findings as a result of his investigation, that even if respondent did not commit the alleged rape, nevertheless, he was guilty of other misconduct. The Solicitor General made another complaint charging the respondent of falsely and deliberately alleging in his application for admission to the bar that he is a person of good moral character, of living adulterously with Briccia Angeles at the same time maintaining illicit relations with the 18 year old Josefina Royong. Thus rendering him unfit to practice law, praying that this Court render judgment ordering the permanent removal of the respondent as lawyer and judge.<br /><br />ISSUE:<br /> Whether or not the illicit relation of the respondent with Josefina Royong and the adulterous cohabitation of respondent with Briccia Angeles warrants disbarment.<br /><br />HELD:<br /> Ariston Oblena was disbarred.<br /><br />RATIO:<br /> The continued possession of a fair private and professional character or a good moral character is a requisite condition for the rightful continuance in the practice of law for one who has been admitted, and its loss requires suspension or disbarment even though the statutes do not specify that as ground for disbarment.<br /> Respondent's conduct though unrelated to his office and in no way directly bearing on his profession, has nevertheless rendered him unfit and unworthy of the privileges of a lawyer.<br />Fornication, if committed under such scandalous or revolting circumstances as have proven in this case, as to shock common sense of decency, certainly may justify positive action by the Court in protecting the prestige of the noble profession of the law.<br />As former Chief Justice Moran observed: An applicant for license to practice law is required to show good moral character, or what he really is, as distinguished from good reputation, or from the opinion generally entertained of him, the estimate in which he is held by the public in the place where he is known.<br />Respondent, therefore, did not possess a good moral character at the time he applied for admission to the bar. He lived an adulterous life with Briccia Angeles, and the fact that people who knew him sqemed to have acuuiesced to his utatus, did noq render him a person of good moral character. Cuevas, Jr. was convicted for Reckless Imprudence Resulting in Homicide, for his participation in the September 1991 initiation rites of LEX TALIONIS FRATERNITY (San Beda College of Law) wherein a neophyte Raul Camaligan died as a result of personal violence inflicted upon him.<br />(2) Petitioner applied for and was granted probation. On May 10, 1995, he was discharged from probation and his case was closed and terminated.<br />(3) Petitioner was allowed to take the bar examinations subject to the condition that; should he pass he will not be allowed to take the lawyer’s oath pending approval by the Court.<br />(4) Petitioner passed the 1996 Bar Examinations. Petitioner prays that he be allowed to take the lawyer’s oath.<br /><br />ISSUE:<br />(1) Whether or not petitioner Cuevas has the moral fitness required to take the lawyer’s oath?<br /><br />HELD:<br /> Petitioner is allowed to take the LAWYER’S OATH and sign the ROLL OF ATTORNEYS.<br /><br />RATIO:<br /> The Court shares the sentiment of Atty. Camaligan, father of hazing victim Raul Camaligan, and condoles with the untimely death of a son who is expected to become a lawyer and succeed his father. In his comment submitted to the Court, Atty. Camaligan submits petitioner’s plea to be admitted to the membershop to the Philippine Bar, to the sound and judicious discretion of the Court. <br />The deliberate participation of Cuevas in the senseless beating of a helpless neophyte which resulted to his death indicates that petitioner does not possess the moral fitness required for admission to the Bar. However, petitioner was discharged from probation without any infraction thereafter of the conditions of the probation and the various certifications attesting to his righteous, peaceful and civic-oriented character prove that he has taken decisive steps to purge himself of his deficiency in moral character and atone for the unfortunate death of Camaligan. TM-223: Herein petitioners - The MERCADO (siblings) filed an action for partition with the Court of First Instance (CFI) Cavite Br. 1 against the SAMONTE siblings. The defendants filed their answer to the complaint thru their counsel, Atty. Danilo Pine.<br />(2) CFI rendered judgment in favor of petitioners. Since no appeal was made by any of the defendants, the decision became final and executory, then the trial court issued the corresponding writ of execution.<br />(3) Before the writ of execution could be carried out, the defendants filed a petition for certiorari and mandamus seeking to annul the writ of execution. The Court of Appeals dismissed the petition for lack of merit.<br />(4) CIVIL CASE NO. C-2442: Respondent Lucina and Trinidad Samonte filed an action before the CFI of Rizal for the annulment of the judgment rendered by the trial court on CIVIL CASE NO. TM-223, alleging that they did not authorize anyone including Atty. Pine to represent them in said case. Pine is duly authorized to represent petitioner in the case at bar?<br /><br />HELD:<br /> Petition is granted and respondent judge of the CFI or Rizal is ordered to dismiss Civil Case No. 2442.<br /><br />RATIO:<br />(1) BP 129 enacted August 10, 1982, transferred jurisdiction over actions for annulment of judgment to the Court of Appeals. Although the prevailing rule before the enactment of BP 129 was that the CFI and their branches have jurisdiction to annul each other’s final judgments. However fundamental principles still dictate that the better policy, as a matter of comity or courteous interaction between courts of first instance and branches thereof, the annulment of cases to be tried by the same court or branch which heard the main action sought to be annulled, pursuant to judicial stability, the doctrine of non-interference should be regarded as highly important in the administration of justice whereby the judgment of a court of competent jurisdiction may not be opened, modified or vacated by any court of concurrent jurisdiction.<br />(2) An attorney is presumed to be properly authorized to represent any cause in which he appears, and no written power of attorney is required of him to appear in Court for his client.
